You must be at least 13 years old to use nextup. By using the app, you represent that you are 13 or older and that the information you provide is accurate. If you are under the age of majority in your jurisdiction, you may use nextup only with the involvement of a parent or guardian.
You are responsible for your account and for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at nextup.lfm@gmail.com if you suspect unauthorized use.
nextup helps people schedule, find, and join pickup sports games—both one-off and recurring—and coordinate with friends and groups through messaging and shared game activity. You are responsible for your own conduct, safety, and decisions when arranging or attending any game or meeting other users in person.
When using nextup, you agree that you will not:
You are solely responsible for the content you post and the messages you send.
nextup provides tools to report objectionable content, messages, or users, and to block users so they can no longer interact with you. We review reports and act on violations of these Terms within a reasonable time, including by removing content and suspending or terminating offending accounts.
To report a concern directly, contact nextup.lfm@gmail.com. We may take action on any content or account that violates these Terms at our discretion. We do not tolerate users who engage in abusive behavior toward others.
You retain ownership of the content you create in nextup (such as messages, profile information, and game details). By posting content, you grant nextup a non-exclusive, worldwide, royalty-free license to host, store, display, and share that content as necessary to operate and provide the app's features (for example, delivering your messages to their intended recipients or showing your games to relevant users). This license ends when your content or account is deleted, except for content already shared with others or where we must retain it to comply with the law.
We may suspend or terminate your access to nextup at any time, with or without notice, if you violate these Terms, engage in objectionable conduct, or create risk or legal exposure for us or other users. You may stop using nextup and request deletion of your account at any time by contacting nextup.lfm@gmail.com.
nextup is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure. nextup helps coordinate games and connections between users, but we are not responsible for the conduct of any user, the safety of any game or venue, or any interaction that occurs in person or online. You participate in games and interact with other users at your own risk.
To the fullest extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, injury, or harm arising out of or related to your use of nextup, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the app is to stop using it.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of nextup after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of nextup will be subject to the exclusive jurisdiction of the state and federal courts located in California.
